User Agreement for PurifyCleaner

1. Acceptance of Terms

Welcome to PurifyCleaner (the "Application"), developed and operated by ZESTFUL LIMITED ("we", "us" or "our"). This User Agreement (the "Agreement") governs your access to and use of the Application and all related services, features and functions provided therein.

By downloading, installing, accessing or using PurifyCleaner on your iOS device, you ("you" or "User") acknowledge that you have read, understood and agree to be bound by this Agreement and our separate Privacy Policy. If you do not agree to any part of this Agreement, please do not use our Application.

2. Description of Services

PurifyCleaner is a multimedia tool application that provides functions including but not limited to file format conversion, multimedia file management, playback and other auxiliary multimedia processing services for personal use. We reserve the right to modify, update, suspend or discontinue any function of the Application at any time without prior notice.

3. Eligibility

You represent and warrant that you are at least 13 years of age. If you are under the age of majority in your jurisdiction, you shall use this Application only under the supervision and consent of your parent or legal guardian. You agree to use the Application in compliance with all applicable local, national and international laws and regulations.

4. User Conduct & Prohibited Activities

You agree to use PurifyCleaner solely for lawful, personal and non-commercial purposes. You shall not:

• Use the Application to process, convert, distribute or disseminate any multimedia files, content or materials that infringe copyright, trademark, portrait right, privacy right or other intellectual property rights and legal rights of any third party;
• Use the Application for illegal, harassing, fraudulent, harmful, obscene, violent or other improper activities;
• Attempt to reverse engineer, decompile, disassemble, modify, crack or tamper with the Application, its code, algorithms and built-in functions;
• Interfere with the normal operation of the Application, attack our servers, or use plug-ins, third-party tools to manipulate the Application functions;
• Share, rent, sell, lease or sublicense the Application or its services to third parties for commercial purposes without our written authorization;
• Upload or process any malicious files, viruses or harmful programs through the Application.

You shall bear full legal responsibility for all multimedia files and content you import, process or export via PurifyCleaner.

5. Intellectual Property Rights

All intellectual property rights in and to PurifyCleaner, including but not limited to software code, interface design, trademarks, logos, text, graphics, icons and all service content, are the exclusive property of ZESTFUL LIMITED. You are granted a limited, non-exclusive, non-transferable license to use the Application on your authorized iOS device in accordance with this Agreement.

You may not copy, reproduce, distribute, publish or use our intellectual property without our prior written consent.

6. Privacy

Your use of the Application is also subject to our Privacy Policy, which explains how we collect, use, store and protect your personal information. The Privacy Policy is incorporated into this Agreement by reference.

7. Disclaimer of Warranties

THE APPLICATION AND ALL RELATED SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE MAKE NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.

We do not warrant that the Application will operate uninterrupted, error-free, fully compatible with all iOS devices or all multimedia file formats. We shall not be responsible for any file loss, file damage or format conversion failure caused by your improper operation, device failure or network abnormality.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ZESTFUL LIMITED SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFIT, BUSINESS INTERRUPTION OR PERSONAL LOSS, ARISING OUT OF OR RELATED TO YOUR USE OR INABILITY TO USE THE APPLICATION.

9. Termination

We reserve the right to suspend or terminate your access to PurifyCleaner immediately if we determine that you have violated any provisions of this Agreement or applicable laws. Upon termination, you shall stop all use of the Application immediately.

10. Modification of Agreement

We may update this User Agreement from time to time. We will post the revised Agreement within the Application or on our relevant page. The updated Agreement shall take effect upon posting. Your continued use of the Application after the update constitutes your acceptance of the revised terms.

11. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction where ZESTFUL LIMITED is registered, without regard to its conflict of law rules. Any dispute arising from this Agreement shall be resolved through friendly negotiation; if negotiation fails, both parties agree to submit to the exclusive jurisdiction of the competent courts of the aforesaid jurisdiction.
